Overtime Pay or Minimum Wage

Under the federal Fair Labor Standards Act (FLSA) employers are required to pay "non-exempt" employees at least one and one-half (1½) times their regular rate of pay for hours worked in excess of forty (40) in a workweek.

Employers are also required to pay a minimum wage of not less than $5.85 per hour effective July 24, 2007; $6.55 per hour effective July 24, 2008; and $7.25 per hour effective July 24, 2009.

However, exempt employees are not subject to this law because they are not typically expected to work set hours. Exempt employees are most often found in managerial and supervisory positions. In many instances, employers either intentionally or unintentionally misclassify employees as "exempt" to avoid paying overtime. This can happen because the definition of exempt is far from clear and can be applied incorrectly even by a well-intentioned employer.

Right to Temporary Leave From Work

Under the federal Family and Medical Leave Act (FMLA) an eligible employee is entitled to take up to 12 weeks of unpaid leave for any of the following reasons:

  • Childbirth - for the birth and care of a newborn child;
  • Sick Loved One - to care for an immediate family member (spouse, child, or parent) with a serious health condition; or
  • Serious Medical Condition - to take medical leave when the employee is unable to work
    because of a serious health condition.
  • Adoption or Foster Care - for placement with
    the employee of a son or daughter for adoption or foster care;

Further, you must be restored to the same position upon return to work after this leave period or a position that is substantially equal in pay, benefits, and responsibility.
